Pluots out of patent

Figured I’d ask some of you guys here. Does anyone have a list?

There is a CRFG list which is a few years out of date

I saw a more recent one but cannot remember where.

Oh at the end of this doc it lists a few which were not off as of 2012 but are off now - the dates going off are shown there.

I don’t keep track of all pluots, but here are some varieties for which I have data:

Flavor Queen is also off-patent, including trilite peachplum, Flavorella plumcot, and Flavor Delight Aprium.

Flavorich is also off patent. There is a nice application where you can search whether variety is patented. I will create separate thread for that

DWN website also has a list of everything grown by them that is still on patent.

Wow!! Ask and you shall receive. Thanks for all the input. Helps narrow down my grafting choices.

Anything below PP09500 is 20 yrs past the filing date and off patent as of now (edit: opps a little premature, PP09500 doesn’t expire until April 9th). Anything under 10,000 you need to check to see when it goes off patent. Anything older than that your kids can check on. Legally you cannot graft (propagate) until after the patent expires. I have no idea about obtaining scions before then though I suspect selling scions before then would be frowned upon.

I haven’t officially published this page of my site yet, but here’s the patent data page:

It updates dynamically (I don’t have to manually maintain it) based on records in the site database so it will continue to be current. I’ve been expanding the database it at a pretty rapid pace so the list will grow.

Also interesting: I’ve found at least three Dave Wilson Nursery patent numbers on their website that were incorrect.

I think that’s a good general guideline, but just wanted to point out I don’t think it’s 100% accurate. I believe the patent number is given based on the patent grant date, which doesn’t correlate perfectly with the filing date.

For example, Earli-Autumn Apricot is 9937.

Also, a little known fact I learned because it applied to me, there are patent maintenance fees that must be paid to keep the patent in force for that full duration. They aren’t cheap.
